September 13, 2005 Matheson Cosponsors "Good Samaritan" Bill for Contractors Helping With Katrina CleanupWashington DC-Congressman Jim Matheson is cosponsoring legislation-HR 3717-- that offers limited liability relief for construction contractors who serve as "good Samaritans" during disasters. The measure-originally conceived prior to the destruction from Hurricane Katrina-has gained new urgency in the storm's aftermath. Matheson said that following disasters such as the 9-11 attacks or natural catastrophic events, construction contractors are needed to help with search, recovery and cleanup efforts. But many companies who are eager to help worry about the lack of liability protection afforded under normal government contracts. "After September 11, it took 30 days for government contracts to be awarded. Many companies volunteered immediately so that their cranes and heavy equipment could be used by search and rescue teams-without liability protection," said Matheson. "The legislation I am cosponsoring would provide limited liability coverage until contracts are awarded." Matheson said many states have "Good Samaritan" legislation to cover those who respond to emergencies, although the statutes vary in scope and coverage. The federal legislation would not cover gross negligence or willful misconduct. "Construction companies are doing the right thing by stepping up immediately to offer help," said Matheson. "The fear of lawsuits should not hinder that mindset. This bill eases that concern during the time period when every second counts." # # # | |
